Information Collection and Use

LoanBack is the sole owner of the information it collects. LoanBack may collect information at several different stages.

  • We request certain sensitive information to help us serve your needs, provide customer service, offer new products and services and fulfill contractual and legal regulatory requirements.
  • We require the submission of certain personally identifiable information (i.e., name and email address) when you utilize our services and products.
  • We collect anonymous, aggregate information from all visitors to the Site. This type of information is never linked to any personally identifiable information and is only used in the aggregate to generate statistical reports about the use of our Site.
  • Your name and email address are required if you send an email inquiry to our customer service department.

Personal Information of Children Under 13

LoanBack complies with the requirements of the Childrens Online Privacy Protection Act (COPPA) and the FTC’s Rules interpreting COPPA (16 CFR 512). The Site is not directed to children and does not knowingly collect any personally identifiable information from children under 13 years of age.

Protection of Your Personal Information

LoanBack does not sell, rent or share customer information with any third party not affiliated with or owned by LoanBack, except service providers who assist LoanBack in such areas as data storage or direct mailing. LoanBack will never give or sell your personal information to be used for the purposes of sending you unsolicited commercial offers (such as spam) from any third party. We may send you infrequent email notices regarding LoanBack products or services that may be of interest to you. You may choose not to receive these notices when you first register. We may need to contact you regarding the status of your account or in response to a request form you.

Profile

We may store information that we collect through cookies and log files to create a profile of our customers. A profile is stored information detailing how individual customers use the Site and our services. Collected information in a profile is tied to the customer’s personally identifiable information. We will disclose personal information when required by state or federal law, or, if we have a good-faith belief that such action is necessary to comply with current judicial proceedings, a court order or legal process served on us, or with the request of state or federal government agency.

Business Transactions

In the event LoanBack goes through a business transition, such as a merger, acquisition by another company, or sale of a portion of its assets, our customers’ personal information may be a part of the assets transferred. Customers will be notified via prominent notice on our Site for 30 days prior to a change of ownership or control of their personal information, as well as by email for those who have elected to permit email communications. If, as a result of the business transition, your personally identifiable information will be used in a manner materially different from that stated at the time of collection, you will be given a choice to opt out of the change.

Security

LoanBack takes commercially reasonable precautions to protect our customers’ information. Such precautions include, but may not be limited to, encryption of any change in personal information following log-in with the industry standard SSL 128-bit encryption. However, given the nature of the Internet and the fact that network security measures are not infallible, we cannot guarantee the security of your information. While we use encryption to protect sensitive information online, we also make an effort to protect your information off-line. All of our customers’ information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information. All employees are kept up-to-date on our security and privacy practices. Finally, the servers that store your personally identifiable information are housed in a secure environment.

Correcting, Updating, Deleting and Deactivating Personal Information

If your personally identifiable information changes, you may correct, update, or delete and deactivate our record of your personally identifiable information. Sign in to your account to change your information.

Notifications of Changes

In the event there are changes to our privacy policy, we will post a notice on the main page of the Site to alert you about the change. In addition, if we make any changes in our privacy practices that do not affect customer information already stored in our database, we will post a prominent notice on our Site notifying customers of the change.
